GUARDIANSHIP OF ANTHONY J. S., Pursuant to SCPA Article 17-A (143 G 1979/A) – This is a proceeding pursuant to Article 17-A of the Surrogate’s Procedure Act seeking to appoint a successor standby and first alternate standby guardian of the person of the respondent, an intellectually disabled person.By decree dated July 18, 1979 this court determined that the respondent was intellectually disabled and appointed the petitioner, his mother, as guardian of his person, appointed William S., now deceased, as standby guardian and Richard K., who now resigns and submits a consent to the application, as alternate standby guardian. The petitioning guardian now seeks to substitute one cousin of the respondent as proposed standby guardian and another cousin of the respondent as first alternate standby guardian. The court is satisfied that the proposed successor standby and first alternate standby guardians are qualified to serve as the respondent’s guardian.Accordingly, the application is granted. The respondent’s cousin, Kim R. H., is appointed standby guardian of his person to serve when the guardian is no longer able to do so. Another cousin, Kenneth R., is appointed first alternate standby guardian to serve when neither the guardian nor the standby guardian are able to do so. The order to be entered hereon shall amend the July 18, 1979 decree to vacate the appointment of the now deceased and now resigned standby and first alternate standby guardians. The successor guardians shall assume the duties of their office subject to qualification and confirmation pursuant to SCPA 1757.The Chief Clerk shall mail a copy of this decision and the decree to the pro se petitioner.Decree signed.August 23, 2018
