ESTATE OF ANGELO ACOCELLA, Deceased (15/1225/C) — In this proceeding commenced by the decedent's spouse seeking, inter alia, a determination that she validly exercised her right of election pursuant to SCPA 1421, the spouse moved for summary judgment seeking to dismiss the executor's objections to her petition and a finding that her election is valid. On the last date the matter appeared on the calendar the parties entered into a settlement on the record in open court which provided, inter alia, that the spouse would receive a sum certain in full satisfaction of her right of election and would waive any other possible interest she might have in this estate. The parties are to submit a written stipulation to the court signed by all parties along with a proposed order, and the matter is marked "settled pursuant to the parties' stipulation."
