Electronic cigarette proponents suffered another setback in New York City, where a state appeals court agreed the ban on “vaping” in restaurants, bars and other venues is constitutionally sound.

The Appellate Division, First Department’s ruling in NYC C.L.A.S.H. v. City of New York, 152723/14, is the latest local salvo in what has grown into a national debate on the health effects of e-cigarettes, and whether their use can lead to the use of tobacco, especially among minors.
