In a case of first impression, the Appellate Division, Second Department, has upheld the constitutionality of a state law requiring nonresident plaintiffs to post security for costs for which they are liable if they lose their case.

The plaintiff, Charmaine Clement, had sued to recover damages for injuries resulting from a collision with a New York City Police Department car in Brooklyn, and was ordered to post a $500 security.
