Travis Kalanick, the CEO and co-founder of Uber Technologies Inc., has lost a motion to dismiss a lawsuit accusing him of using the company’s pricing algorithm to violate antitrust laws.

Southern District Judge Jed Rakoff denied Kalanick’s motion in the putative class action of Meyer v. Kalanick, 15 Civ. 9796, where Uber rider Spencer Meyer alleges that Kalanick, although denying he was running a transportation company, restricts price competition for cars for hire because his Uber app sets the fares charged by drivers and there is no incentive to compete for price.
