Michael Garcia was confirmed to the Court of Appeals Monday by the New York state Senate in a unanimous voice vote, becoming the first Hispanic man to sit on the state’s highest court.

Garcia, 54, had been unanimously recommended for confirmation by the Senate’s Judiciary Committee earlier in the day after an hour-long hearing, where he told the Republican-controlled panel that he supported the U.S. Supreme Court’s ruling in Roe v. Wade, which overturned state laws banning abortion, and that the U.S. Constitution’s Second Amendment confers on individuals a right to bear arms.
