A defendant sentenced to 42 years for gun trafficking must be retried because of a judge’s mishandling of a jury note, the Appellate Division, First Department, has ruled.
A unanimous panel on Tuesday reversed the January 2013 conviction of Sentell Smith on 21 counts relating to the sale of 11 guns, including an assault rifle.
