An elementary school teacher who alleges that the vice president of her school’s PTA said the teacher “makes children cry every day” can proceed with her defamation suit, a judge has ruled.

Nassau County Supreme Court Justice F. Dana Winslow said that while the vice president, Victoria Trum, could be seen as having expressed a non-actionable opinion, she also could be viewed as having made a statement of fact or a statement of mixed fact and opinion with a “precise, literal interpretation.”
