A prosecutor can be sued for ordering the arrest of a man who enclosed some obscene words with his payment for a speeding ticket in the Catskills town of Liberty.
Southern District Judge Cathy Seibel said the First Amendment rights of motorist Willian Barboza were violated when he was arrested for aggravated harassment at the Liberty Justice Court for adding a vulgar message to his payment form in 2012.
