ESTATE OF BERNARD BURACK, (13/1536/C) — In this miscellaneous proceeding, Rachel Kowal petitions for Howard Weiss’s removal as co-Trustee of the Nancy J. Burack Real Estate Trust created under the will of decedent Bernard Burack. After the court heard arguments on the record, the parties consented to the court’s determination of the petition based on their submissions.

Decedent died on September 30, 2012, survived by his wife, Nancy Burack (“Ms. Burack”), and four children: Petitioner, Joshua, Froma, and Aaron Burack. Decedent’s will (dated January 28, 2011) and codicil (dated June 29, 2012) were admitted to probate on July 5, 2013, with Letters Testamentary issuing to Ms. Burack and Letters of Trusteeship for the Nancy J. Burack Real Estate Trust, created under Article Third of the will, issuing to Petitioner, Ms. Burack, and Howard Weiss, whom the codicil nominated as co-trustees. The Trust was created for the primary benefit of Ms. Burack during her lifetime, with the remainder to decedent’s children and grandchildren. It was funded with the titles to two of decedent’s apartments, one located in New York and the other in Florida.
