ROSE WROBEL, Deceased (734P/01/A) — Pending in these estates are two uncontested applications seeking, inter alia, to judicially settle the executor’s accounts in both estates and other incidental relief. The sole beneficiary of both estates is the decedents’ daughter who is under a disability. After the death of both parents, by order dated July 9, 2003 this court appointed a successor guardian of the person of the daughter pursuant to Surrogate’s Court Procedure Act article 17-A, and directed that accounts be filed in her parents’ estates. Accounts in both estates were filed on February 5, 2009 and a guardian ad litem was appointed for the daughter to review the accounts.

In addition to seeking to judicially settle her accounts, the executor, an attorney admitted in another state seeks, inter alia, approval of advance payment of commissions to herself as executor of both estates, nunc pro tunc from the date taken, which were taken without court approval. The executor also requests an order permitting the consolidation of three separate supplemental needs trusts established by the decedents for the daughter’s benefit, nunc pro tunc to March 1, 2003, the date the executor, acting as trustee for two of the trusts, consolidated the three trusts based on what she avers is “bureaucratic efficiency.” The executor also seeks approval of all attorneys’ fees and disbursements she paid in both estates.
