ESTATE OF VITA VAUGHAN, Deceased. (14/721) — In this contested administration proceeding, a motion was brought by Julia Vaughan, decedent's daughter, to (1) vacate a Kings County Sua Sponte Order dated June 25, 2014 revoking Julia Vaughan's authority as Administratrix and transferring the matter to Richmond County, (2) reinstate Julia Vaughan as administrator, and (3) transfer this matter back to Kings County. The Respondent, Cara Buonincontri, Esq., the decedent's Court appointed guardian prior to death and now a creditor of the estate, opposes the relief requested. Counsel for both sides submitted papers with respect to their positions and argued orally before the Surrogate.

The issue herein is not an issue of domicile or venue, but rather, whether the relief the Petitioner is seeking is properly brought in this Court. Essentially, the Petitioner is asking that the Surrogate of Richmond County vacate an order rendered by the Surrogate in Kings County.
