ESTATE OF WALTER TROTMAN, Deceased (10/1999/D) — In this contested proceeding to judicially settle the account of the executor, a son of the decedent, pro se objections to the account were filed by four beneficiaries, who objected to, inter alia, 1) payment of commissions; 2) the proposed distributions; 3) the appointment of the executor as trustee of a trust to be created for one of the objectants pursuant to the terms of the will; and, 4) to the attorneys’ fees as being excessive. On an adjourned return date of the proceeding a conference was held with the attorney for the executor and with the four pro se objectants. A stipulation was “so ordered” which provided that counsel for the executor was to provide the court and the objectants with a letter in response to the pending objections and the parties were to appear on August 19, 2014 for a compliance conference.

Thereafter, the court received correspondence from the executor’s attorney along with an affidavit from the executor wherein the executor agreed, pursuant to the objectants’ request, to reduce his commissions and also consented that “distribution of the bequest to Ashley Trotman pursuant to Paragraph NINTH of the Last Will and Testament, be made outright to her and not be held in Trust.” The attorney also indicated that the letter and affirmation had been mailed to the four objectants and he requested that to the extent the objectants agreed with the two items addressed by the executor in his affidavit they would “append their consent to the accounting.”
