ESTATE OF LOWE, Deceased. (86/A/577 P) — In this contested final accounting proceeding, certain parties have settled their differences by way of written settlement agreement filed with, and "So Ordered" by, the court. JPMorgan Chase Bank, N.A. ("JPMC") is the petitioner in this proceeding, with an accounting covering the period October 20, 2000, through June 30, 2010, in which it is accounting as both executor and trustee of all trusts created under the last will and testament of Edwin S. Lowe. This accounting was amended by petitioner. Objections to this account, as amended, were filed by Barbara Fodor ("Barbara"), Gail Lowe Maidman ("Gail"), Evan Adam Haymes ("Evan"), and Starr Elizabeth Haymes, now known as Starr Haymes Kempin ("Starr"). Provided that the use of virtual representation is granted by the court, JPMC has settled with all parties other than Gail.

As part of the settlement, petitioner requests that the virtual representation statute, SCPA 315, be invoked in order to dispense with service of process upon certain contingent remaindermen of the trusts. This particular request must be addressed before considering the balance of petitioner’s requests so that jurisdiction may properly be obtained in the pending accounting proceeding.
