The Appellate Division, Third Department, affirmed a summary judgment ruling allowing a claim for negligent training and supervision of an employee in a juvenile treatment facility to go forward, saying the plaintiff, who had been raped by the employee, had satisfied the “knowledge of propensity” and “proximate cause” requirements to require a trial.

The case, Nolette v. Berkshire Farm Center, No. 518429, stems from the 2008 rape of a 14-year old by an employee of a juvenile facility near the upstate town of Glens Falls.
