Before deciding whether a convicted terrorist is entitled to discovery connected to a belated prosecution notice about warrantless surveillance, a federal judge wants to know if the defendant will withdraw his guilty plea.

Agron Hasbajrami was arrested in September 2011 as he was about to travel from New York to Turkey and then Pakistan, where he hoped to join jihadist organizations. In January 2013, Eastern District Judge John Gleeson (See Profile) sentenced Hasbajrami to a 15-year term after he pleaded to attempting to provide material support to terrorists. Hasbajrami faced up to 60 years under the charges.
