The psychologist treating a man who killed and dismembered a Long Island woman and the private mental health facility where he lived must face trial for liability in a suit brought by the woman’s family, a state judge has decided.

Nassau County Supreme Court Justice F. Dana Winslow (See Profile) said he could have determined on his own the extent of the duty owed to the murder victim, Denice Fox, based on the “extraordinarily cogent and convincing points” that both sides made during the protracted litigation. But the judge said “such a determination is properly reached after the facts and issues previously articulated are considered by a jury.”
