ALBANY – Thanks to a seldom-invoked provision of the CPLR with 19th century roots, a follow-up suit to the landmark Campaign for Fiscal Equity school funding litigation will shift temporarily from Manhattan to Albany.

Supreme Court Justice Manuel Mendez (See Profile) approved a venue change to decide the plaintiffs’ motion for a preliminary injunction that would force the state to immediately release more than $1 billion in state school aid that is allegedly being withheld in violation of the Campaign for Fiscal Equity [CFE] case. CFE, litigated between 1993 and 2006, ultimately resulted in a court directive that schools in New York City and elsewhere receive more state funding to fulfill the mandate in the state constitution that public school children are entitled to a “sound, basic” education.
