A former public information officer for the state Thruway Authority cannot sustain a federal action alleging he was ousted for political speech and for being a whistleblower, a judge in Rochester has held.

Brian Rusk, who served as an assistant press officer for 14 years, was fired in 2010 after an inspector general report found he was operating a private public relations consulting business on state time and with state resources.
