A Manhattan Housing Court judge has ruled that a tenant who rented out her apartment through the popular website Airbnb cannot be evicted now that she has stopped.

Judge Jack Stoller (See Profile) ruled Monday in Gold Street Properties v. Freeman, 90185/13, that Kimberly Freeman had timely complied with the landlord’s request that she stop renting out her apartment on Airbnb, and therefore there were no further grounds for eviction. Freeman did not dispute that she rented out her apartment in 33 Gold Street in lower Manhattan on multiple occasions for $129 to $200 a night. She pays $2,350 per month in rent.
