ESTATE OF JULIUS GLASSER, Deceased (480A/95/A) — In this withdrawal proceeding, a kinship hearing was held before a member of the court’s Law Department designated to hear and report, upon the consent of all parties. More than 10 days have elapsed since the mailing of the referee’s report, and no party has moved to modify or overrule the report.

After review by the court, the findings of fact and conclusions of law set forth in the report are confirmed, including that the decedent: (1) was not survived by any maternal distributees; (2) was survived by one paternal aunt, Etta Schiller, who postdeceased the decedent on November 7, 2001, and whose estate is entitled to one-third of the entire net distributable estate; and, (3) was survived by five paternal first cousins, who are the issue of two predeceased maternal uncles namely, Steven Glasser, Mark Glasser, Beverly Meyer, Mery Finkle and Norbert Glasser, the latter of whom post-deceased, each of whom is entitled to two-fifteenths of the entire net distributable estate (EPTL 4-1.1 a] [6]). The shares payable to the post-deceased distributees shall be paid to the duly appointed fiduciaries of their respective estates.
