Appellant Cach LLC appealed from a Civil Court order which granted defendant Woodsnajac’s motion to vacate a judgment. The order also directed restitution of monies Cach collected in enforcement of the judgment in this action to recover for breach of a credit card agreement. The parties previously entered into a so-ordered stipulation of settlement, but defendant defaulted, entitling Cach to enter judgment in the full amount sued for. Cach entered judgment and garnished defendant’s income. Defendant moved to vacate the judgment which the civil court granted, without engaging in any fact finding or setting forth any rationale for its decision. The unanimous panel found no grounds existed, or were alleged, to vacate the stipulation, noting the judge was merely presented with defendant’s statement acknowledging the settlement existed, that she only made one payment, and the rest were secured through garnishment. Yet, defendant failed to offer any basis why she did not comply with the stipulation or a ground for vacating the judgment, yet the court inexplicably granted the motion. The panel ruled the court grossly abused its discretion in granting such relief, reversing the order and denying defendant’s motion to vacate the judgment.
