IN THE MATTER OF THE GUARDIANSHIP OF ADAM N. L., (2979/12) — This is a proceeding pursuant to Article 17-A of the Surrogate’s Court Procedure Act for the appointment of the petitioners as guardians of the person of the respondent, an alleged mentally retarded person.

When the parties appeared on the return date of the citation, an application was made by the petitioners on the record in open court to amend the petition to nominate the respondent’s sister, Risa L., as standby guardian, and she confirmed her willingness to act as standby guardian. The court, on the record in open court, deemed the petition amended to include her as the nominated as standby guardian. Upon the oral and documentary proof adduced at the hearing at which the proposed guardians and the respondent appeared, it appears to the satisfaction of the court that the respondent is a mentally retarded person within the provisions of Article 17-A of the SCPA and that he lacks the capacity to make healthcare decisions. The court is also satisfied that the petitioners and the proposed standby guardian are qualified to assume the responsibility as serving as respondent’s guardian.
