Ifund LLC sought to enforce an order against Hollis Medical Care PC in favor of GEICO. Defendants Baker Sanders LLC and Aminov are attorneys retained by Hollis to collect receivables related to non-payment of no-fault benefits for services rendered to insured patients. Ifund alleged Baker Sanders holds an estimated $80,000 on Hollis’s behalf and possesses files for collection actions valued at $260,000, and that Aminov holds an estimated $150,000 on Hollis’s behalf and possesses files for collection actions valued at $50,000. Ifund sought both Hollis’s money and collection action files in defendants’ possession. Defendants cited ethical concerns with the legality of the settlement, and assignment of the GEICO judgment to Ifund. Among the defendants in the GEICO action was Hsu, who was at various times an owner of Hollis, and later indicted for conspiracy to commit health care fraud and other crimes. In light of Hsu’s sentencing and presumably satisfaction of his plea agreement, the court found the existence of questions that merit additional exploration before being able to determine if any relief should be granted, including whether the Hollis collection action claims were dismissed pursuant to Hsu’s plea agreement or for any other reason.
