A New York City tribunal has reversed an administrative law judge’s ruling to impose a $2,400 fine against a tenant who rented out his Manhattan apartment to tourists through an online booking site.

The city’s Environmental Control Board on Sept. 26 determined that Nigel Warren should not have been penalized for his use of the Airbnb website to rent out his Lower East Side bedroom to a Russian tourist for three days while he was out of town. Warren’s roommate was in the apartment while the tourist stayed there.
