Strippers at a New York club are employees and not independent contractors for purposes of the Fair Labor Standards Act, a federal judge held Tuesday.

Southern District Judge Paul Engelmayer (See Profile) said that strippers, or exotic dancers, who work at Rick's Cabaret in Midtown Manhattan are entitled to receive minimum wage. He also ruled that, under the act and New York Labor Law, the owners of Rick's Cabaret were unlawfully requesting and receiving part of the dancers' wages and the tips they received—either for dancing on stage and providing intimate "lap" or "table" dances for club clientele at $20 per dance, or for private sessions in private rooms for as much as $400 per hour.
