ALBANY – Suffolk County District Attorney Thomas Spota can stay on the Sept. 10 Republican primary ballot and seek re-election to a fourth term in November, the Court of Appeals ruled Thursday.

The 6-1 court decided that a 1993 law approved by Suffolk County voters limiting their district attorney to three consecutive four-year terms is invalid because district attorneys are "constitutional officers" whose terms and qualifications are set by the state Legislature, not the counties that pay the D.A.s' salaries.
