Landlord-Tenant—Tenant Barred From Filing Further Motions Without Prior Permission From the Court—Continuous and Vexatious Litigation

This action arises from an alleged breach of a lease agreement. The plaintiff-owner of a home had leased the home to his father (defendant). The plaintiff alleged that the defendant had failed to pay the rent due from January 2000 through July 2005, when the agreement terminated. The plaintiff had commenced the subject action in November 2005 and had subsequently moved for default judgment. In May 2006, the court granted the plaintiff’s motion for default judgment and directed that an inquest be held. Following the inquest, the court awarded the plaintiff a judgment in the sum of $95,179.06, with interest. Thereafter, the defendant moved to vacate the default judgment.
