A debt collector who offered a debtor a payment option and issued a threat after receiving a “cease and desist” letter is potentially on the hook for damages under the Fair Debt Credit Collection Practices Act, a federal judge in Buffalo has held.

Western District Judge William Skretny (See Profile) said that HoganWillig’s communication with the debtor, after being told to back off, was improper because it not only offered a payment option but threatened legal action in violation of the act.
