Local governments may not enforce confidentiality rules that are in conflict with disclosure requirements of the state’s Freedom of Information Law, a judge has determined.

Westchester County Supreme Court Justice James W. Hubert (See Profile) ruled that While Plains and its local ethics board cannot withhold some documents sought by The Journal News based on a local law that declares that the “complaints, records and other proceedings” of ethics investigations prior to the filing or dismissal of complaints are “deemed confidential.”
