ALBANY - A hospital that allegedly failed to note that a patient had been overdosed until months after his death, and a doctor accused of abandoning the patient, are potentially on the hook for punitive damages in a medical malpractice action, an appeals court has held.

The Appellate Division, Third Department said the allegations, if proven, evince the degree of “reckless indifference” that could warrant the imposition of punitive damages in a medical negligence case.
