A divided appeals court has overturned the conviction of a mentally ill Bronx man who confessed to a murder after hours of police interrogation, finding that he did not get adequate assistance of counsel because his lawyers did not seek his psychiatric records.

A 3-2 Appellate Division, First Department, majority in People v. Oliveras, 6702/99, which consisted of Presiding Justice Luis A. Gonzalez (See Profile) and Justices Rolando T. Acosta (See Profile) and Sallie Manzanet-Daniels (See Profile), sent the case back to Bronx Supreme Court for a new trial.
