A federal district court in Rochester has declined to expedite proceedings in a contentious battle between the Eastman Kodak Co. and the firm that supplies ink for its commercial line of Versamark ink-jet printers. Last month, Western District Judge David G. Larimer directed the supplier, Collins Ink Corp., to honor its contractual obligations and continue to provide ink to the financially ailing Kodak (NYLJ, Nov. 7).

Collins, expressing concerns over Kodak’s continued viability and ability to pay for the ink, wants to abandon a contract even though Kodak is current on its obligations to the firm. Collins has appealed last month’s ruling to the U.S. Court of Appeals for the Second Circuit.
