Court Rejects Borrower’s Claims That Lenders Were Liable for Issuing Him a Mortgage That They Knew He Could Not Repay—No Doc Loans—GBL 349, Common Law Fraud and Credit Repair Organizations Act Claims Rejected

A plaintiff borrower claimed that the defendants were liable “for their respective roles in issuing him a mortgage that they knew he could not repay.” Defendant lenders “A” and “B” moved to dismiss the complaint for failure to state a claim. A third defendant, a mortgage broker (broker), did not appear in the case. The court granted the motions to dismiss.
