A driver’s delay in making a turn after a traffic light turned green did not justify the police stopping his car and subsequently arresting him for drunken driving, a Nassau County judge has ruled.

After a pretrial hearing in People v. Martinez, 2010NA023365, District Court Judge Andrew M. Engel (See Profile) suppressed the evidence against Carlos M. Martinez—who had slurred speech, bloodshot eyes and admitted to drinking two beers—after determining that Mr. Martinez had not violated any traffic laws that would have given the officer reasonable suspicion to stop him or probable cause to arrest him.
