Finding a question of fact about a municipality’s duty to a local teenager who was assaulted on its basketball courts by a non-resident, a judge has cleared the way for a jury trial in the teen’s suit against the town.

“The Defendant [Town of Hempstead] had reason to know from past experiences that there was a likelihood of conduct on the part of third persons which was likely to endanger the safety of visitors,” Justice Randy Sue Marber (See Profile) wrote in Salone v. Town of Hempstead, 001664-2006.
