The chair of the Real Property Law Section of the New York State Bar Association has objected to a new court-imposed attorney affirmation requirement in foreclosure actions on the grounds that it violates attorney-client confidentiality and unfairly associates an attorney who submits the document with unidentified lawyers around the nation responsible for numerous and widespread faulty filings.

Section chair Anne Reynolds Copps of Albany suggested several changes to the affirmation in a Nov. 2 letter to court officials following up on an Oct. 26 meeting.
