Faulting a land use review board that it said gave short shrift to the facts before it, a state appellate court has approved a variance that will permit developer Donald Trump to build a large restaurant and catering hall at Jones Beach State Park on Long Island.

In a 3-1 decision, the Appellate Division, Second Department, rejected the state board’s “arbitrary and capricious” denial of a variance for the 85,000-square-foot Trump on the Ocean. The panel approved construction of a basement containing kitchens, employee lounges and utility equipment, which would otherwise be barred in a flood-hazard zone such as Jones Beach.
