The state Court of Appeals yesterday issued an order clearing the way for Surrogate Nora S. Anderson to take the bench. A Manhattan jury last week acquitted Surrogate Anderson, who was elected in November 2008, of charges that she had concealed the source of $250,000 received by her campaign. The Court, on its own motion, yesterday terminated the order it had issued on Dec. 29, 2008, suspending Surrogate Anderson with pay as long as felony charges were pending against her. As soon as Interim Surrogate Troy K. Webber returns to Supreme Court in the Bronx, Surrogate Anderson will take the bench, most likely sometime today. – Daniel Wise

Attorney Pleads Guilty to Stealing, Tax Evasion

A personal injury lawyer pleaded guilty yesterday to stealing more than $2.2 million in client funds and failing to file income taxes. Marc A. Bernstein, a former name partner of Bernstein & Bernstein, was accused earlier this year of failing to file tax returns from 2003 through 2007 and understating his gross income in a 2008 return (NYLJ, Jan. 28). The charges of tax evasion against Mr. Bernstein, the son of former Brooklyn Supreme Court Justice Aaron D. Bernstein, came just months after he was arrested for allegedly stealing more than $1.5 million from five clients (NYLJ, July 9, 2009). One month earlier, Mr. Bernstein, 55, spent two days in jail before his father bailed him out by using his pension as collateral.
