A nurse who worked in a Chinese hospital that practiced forced abortions is not barred from seeking asylum in the United States, a federal appeals court ruled yesterday.

For the second time this year, a panel of the U.S. Court of Appeals for the Second Circuit said that the so-called “persecutor’s bar” does not apply to hospital personnel as long as they have not “assisted or participated” in the persecution of others through forced abortions under China’s mandatory family planning policies.
