A fence erected by an industrial park that interferes with views of the Henry Street Basin in Brooklyn constitutes a “public nuisance” and must be removed, a state appellate court ruled last week.

“A riparian owner, such as the City, has a right to equitable relief against material obstructions, including the abatement of an obstruction already constructed,” a unanimous panel of the Appellate Division, Second Department, wrote in City of New York v. Gowanus Industrial Park Inc., 2008-06889.
