ESTATE OF JEAN A. HOLKE, Deceased (3213/07)—Murray H. Shulman, an alleged creditor of the estate of Jean A. Holke, brings this proceeding for the revocation of letters testamentary which issued to the decedent’s daughter, Martha Beverly, on June 26, 2008.

The Court has carefully reviewed all the papers submitted, including the petition with all its exhibits and the additional submissions allowed by the Court from both Mr. Shulman and the respondent after the return of citation. Mr. Shulman complains of various actions of the executor, some of which occurred before the death of the decedent and most of which concern the executor’s refusal to reimburse him for various expenses not compensable from this estate—which is valued at approximately $15,000—such as Mr. Shulman’s own rental expense for the period that he voluntarily cared for the decedent in her apartment, and airfare for flying the decedent’s ashes to Sweden, not authorized by the executor. Mr. Shulman apparently took good care of the decedent in her final weeks, as the respondent acknowledges. His allegations, however, do not constitute grounds for removal of the executor, and the petition is therefore dismissed.
