Despite a general rule requiring service upon a necessary party before the commencement of an eviction proceeding, a Housing Court judge last week permitted service on the co-owner of a cooperative apartment after the completion of a seven-day trial.

Housing Court Judge Sabrina B. Kraus allowed the retroactive service of the eviction petition upon the brother of a woman who had lived in a Greenwich Village apartment for 25 years.
