A federal appeals court has reversed the decision of a district court judge to order a new trial for a man convicted of receiving child pornography because he thought he had made a mistake in refusing to inform the jury that the defendant faced a mandatory minimum prison sentence of five years. "Absent a strong justification for redoing a properly conducted trial, the interests of finality, as well as respect for the jury's verdict, counsel against requiring retrial," Judge Robert Katzmann wrote for the Second Circuit.
