New York’s top court handed down a unanimous ruling on Thursday that revived an investor dispute against online fantasy sports company FanDuel, ordering the matter to continue in a Manhattan Commercial Division court under Scottish law.

The 7-0 decision, authored by Judge Madeline Singas, said a lower court should not have dismissed the case brought by 130 of FanDuel’s founders, early employees and startup funders, who allege the company and two private equity investors left them out of interest from a 2018 merger with European sports bookmaker Paddy Power Betfair.
