In February 2020, a petitioner commenced a nonpayment proceeding against respondents seeking rental arrears in the amount of $8,850.00 for December 2019, January 2020 and February 2020.

There were substantial delays attributable to the COVID-19 pandemic and the respondent’s Emergency Rental Assistant Protection (ERAP) application which was pending. Since the ERAP stay expired, the petitioner moved “to restore the nonpayment proceeding, to amend the petition to date and for entry of the final judgment and issuance of a warrant of eviction for failure to pay the outstanding arrears.”
