Plaintiffs seeking to buy AR-15 style military assault rifles claim in a suit against Westchester County District Attorney Mimi Rocah and Acting Superintendent of the New York State Police Dominick Chiumento that New York’s ban on possessing the weapons violates their Second Amendment rights as incorporated against New York in the Fourteenth Amendment.

U.S. District Judge Kenneth Karas denied defendants’ motion to dismiss suit. Defendants failed to explain how invalidation of the ban would have no effect on the ability to obtain licenses for those same weapons.
