The Appellate Division, First Department upheld a lower court finding that discovery stays pending motions to dismiss under the Private Securities Litigation Reform Act apply in state court cases.
“We may consider the purely legal issue of whether a PSLRA stay applies to actions in state court,” the panel wrote. “We conclude that it does.”
