An oil spill seeping from the banks of Newtown Creek near the Greenpoint section of Brooklyn—a heavily industrialized area in which ExxonMobil (Exxon) has an oil storage facility—was first discovered in 1978.

A 1979 investigative report by the U.S. Coast Guard determined that the spill likely originated from two potential sources, one of which was Exxon’s Terminal. In 2020, a group of Greenpoint residents sued Exxon under state court causes of action for violating New York General Business Law §349 and New York’s Oil Spill Act, and asserting claims including negligence, strict liability, nuisance and trespass.
