Gino DiNucci and William Clifford are antique aircraft enthusiasts and hobbyists. Each owns several vintage aircraft. DiNucci has extraordinary experience in maintaining and repairing aircraft. Soon after meeting 30 years ago, DiNucci began maintaining Clifford’s aircraft, including his vintage 1930 Brunner-Winkle Bird airplane (“Bird”), which since installation of a new engine in 2002 lacks a starter system and needs to be hand-propped.

While attempting to hand-prop Clifford’s Bird airplane on Sept. 16, 2018, its propeller slowed inexplicably before firing again, striking and nearly severing DiNucci’s arm. District court granted Clifford summary judgment dismissing DiNucci’s Apr. 26, 2021, lawsuit alleging negligence, strict liability, and violation of New York General Business Law §251.
